Should the world issue arrest warrants for Israel's military and government leaders for warcrimes?
The israeli terror attack on Gaza is escalating. Already many innocents including children have been murdered. Israel is intentionally bombing areas where they know children are and are basically justifing the murder of kids. This is a war crime. Should the world act and issue warrants warrants for the arrests of the Israeli military and government criminals?
The only war crimes are those being perpetrated by the Hamas Muslim terrorists.
The calculated, cynical use of the civilian population as human shields is intended to decrease the vulnerability of Hamas and the other Palestinian terrorist organizations by affording them immunity from the IDF’s counterterrorism activities, since they are aware that Israel avoids harming the civilian population as much as possible. It is also intended to make it possible for Hamas and the other terrorist organizations to make political-propaganda gains in the battle for hearts and minds by representing Israel as operating against innocent civilians. The terrorist organizations’ doctrine of using human shields was inspired by Hisb'Allah’s tactics in Lebanon and by the lessons they learned from the terrorist campaign they have been waging against Israel since 2000.
Please be aware that Hamas recruits and regularly uses children for hostile activities, which have ranged from the carrying out of suicide attacks, to the digging of tunnels and smuggling of weapons.
Such conduct clearly violates express principles of the Laws of Armed Conflict, including express prohibitions against allowing children to take part in hostilities.
Thus, as expressly provided for by Article 77(2) of Additional Protocol I to the Geneva Conventions of 1949 and Relating to the Protection of Victims of International Armed Conflict (1977):
"The Parties to the conflict shall take all feasible measures in order that children who have not attained the age of fifteen years do not take a direct part in hostilities and, in particular, they shall refrain from recruiting them into their armed forces…"
Moreover, Article 8(2)(b)(xxvi) of the Rome Statute of the International Criminal Court (1998) lists the following acts as a war crime:
"conscripting or enlisting children under the age of fifteen years into the national armed forces or using them to participate actively in hostilities"
